Overview of Active Tribunal Matters Involving Coast Capital and Sean Manak

This page provides an overview of the administrative proceedings associated with the
employment-related matters between Sean Manak and Coast Capital Savings Federal Credit
Union. These proceedings are separate from the civil actions filed in Alberta and British
Columbia and involve several regulatory bodies, including Employment Standards,
WorkSafeBC’s Review Division, and the Canadian Human Rights Commission. A

WorkSafeBC Review Division Status: Review Decision in Manak’s Favour, Final Determination Pending.

A Review Division decision has been issued in Mr. Manak’s favour regarding aspects of the
WorkSafeBC investigation. A final determination is pending. Additional publicly shareable
information will be posted as it becomes available.

Employment Standards Branch (BC) Status: Claim Pending

Mr. Manak has an active Employment Standards complaint relating to alleged unpaid
overtime, excessive hours of work, and failure to provide a safe and healthy work
environment. Evidence submitted to the BC Employment Standards Branch includes work-
hour documentation, internal correspondence, medical records, and capacity analyses.
More than 200 pieces of evidence have been provided to date in support of Mr. Manak’s
position.

During the investigation, Mr. Manak raised several concerns regarding the handling of the
investigation and handling of certain procedural aspects, including instances where
administrative issues appeared to receive attention, he believed disproportionate to their
significance compared to the substantive evidence submitted. For example, attention was
directed to a minor typographical error in a adjudicator’s name contained in one of Mr.
Manak’s submissions, which he believed diverted focus from the substantive evidence
provided. Materials relating to these concerns will be posted when appropriate and in
accordance with applicable disclosure rules.

The matter remains under review by the Employment Standards Branch, and no final
determination has been made.

Canadian Human Rights Commission Status: Complaint Pending.

A complaint has been filed with the Canadian Human Rights Commission relating to alleged
failure to accommodate medical restrictions following Mr. Manak’s hospitalization and
medically induced coma. The matter is currently under assessment by the Commission.
