Coast Capital Employment Standards Violations | 2026 Decision
Coast Capital Auto & Equipment Finance Penalized for Four Employment Standards Act Violations
On September 18, 2026, British Columbia’s Director of Employment Standards issued Determination ES-2024-004516, finding that Coast Capital Auto & Equipment Finance Ltd. breached four provisions of the Employment Standards Act in the employment complaint brought by Shammi (Sean) Manak. The company is part of the Coast Capital Savings Federal Credit Union group.
The contraventions were failure to pay wages on time (section 17), failure to pay all outstanding final wages within the statutory deadline (section 18), failure to maintain required hours-of-work records (section 28), and failure to properly pay overtime (section 40). The decision records that the company acknowledged it had not kept records of Manak’s hours and found that it had failed to properly pay overtime across multiple pay periods. Coast Capital Auto & Equipment Finance Ltd. was ordered to pay $6,559.38 in wages and interest, plus four separate $500 administrative penalties, bringing the total to $8,559.38. The Director also expressly ordered the company to cease contravening the identified provisions and comply with the Act and Regulation. WorkSafeBC Review Division Status: Review Decision in Manak’s Favour, Final Determination Pending.
A Review Division decision has been issued in Mr. Manak’s favour regarding aspects of the
WorkSafeBC investigation. A final determination is pending. Additional publicly shareable
information will be posted as it becomes available.
Employment Standards Branch (BC) Status: Claim Pending
Mr. Manak has an active Employment Standards complaint relating to alleged unpaid
overtime, excessive hours of work, and failure to provide a safe and healthy work
environment. Evidence submitted to the BC Employment Standards Branch includes work-
hour documentation, internal correspondence, medical records, and capacity analyses.
More than 200 pieces of evidence have been provided to date in support of Mr. Manak’s
position.
During the investigation, Mr. Manak raised several concerns regarding the handling of the
investigation and handling of certain procedural aspects, including instances where
administrative issues appeared to receive attention, he believed disproportionate to their
significance compared to the substantive evidence submitted. For example, attention was
directed to a minor typographical error in a adjudicator’s name contained in one of Mr.
Manak’s submissions, which he believed diverted focus from the substantive evidence
provided. Materials relating to these concerns will be posted when appropriate and in
accordance with applicable disclosure rules.
The matter remains under review by the Employment Standards Branch, and no final
determination has been made.
Canadian Human Rights Commission Status: Complaint Pending.
A complaint has been filed with the Canadian Human Rights Commission relating to alleged
failure to accommodate medical restrictions following Mr. Manak’s hospitalization and
medically induced coma. The matter is currently under assessment by the Commission.
